Please read these Terms and Conditions carefully before using our Website. By registering a Player Account on the website, you signify your agreement to the Terms and Conditions.

The laws of Curacao shall apply to the Terms and Conditions. If there are other language versions of the Terms and Conditions, the English version will always take precedence.

If one or more of the terms of the general terms and conditions are declared invalid by a recognized court, the remaining general terms and conditions shall remain in force.

Changes in the terms and conditions

These Terms and Conditions may be amended by the Company as the need arises. The Company will notify players of any material changes. However, we also recommend that you check the “Terms and Conditions” page regularly to see if there are any possible updates.

In the event of any material changes to the Terms and Conditions, you must reconfirm your acceptance before the changes take effect and you will be able to bet on the Website.

Who can use the platform

By accessing and opening an account and using this Website, you represent and warrant that online gambling is legal and permitted in the jurisdiction in which you are located and you will not use the Website while resident or temporarily located in any jurisdiction that prohibits use of the Website.

Setting up a Player Account

As part of opening an account, you will be required to provide personal information such as your first name, last name, date of birth, place of birth, address, nationality and email address. Deposits, Winnings and Withdrawals

Deposits and winnings will be credited directly and immediately to your player account. Withdrawals will be processed at your request.

Payment obligation after the closure of the player account

If the account is closed, the Company will pay the remaining funds to the verified bank account within five (5) business days. There are no fees for processing payouts. Your account must be verified and comply with the terms and conditions. Mandatory Deposit Limit Setting

Upon registration you will be asked to set an individual monthly deposit limit. This deposit limit should not exceed 1,000 EUR per month per player.

Reality check. Additional waiting period after the reality check

From the moment the reality check is activated, you will receive a pop-up window informing you of the elapsed time every hour, which you must actively confirm in order to continue gambling. After confirming the reality check pop-up, you will need to wait an additional five minutes before you can continue gambling.

Disclaimer of liability

By accepting these Terms and Conditions, you acknowledge that you are aware that gambling may result in a loss of money. MCW Casino will not be liable for any financial loss incurred as a result of your use of the Website.

The online bookmaker is not responsible for any hardware or software defects, unstable or lost internet connection or any other technical errors, which may restrict access to the Website or prevent any players from playing uninterruptedly.

In the unlikely event that a bet is confirmed or payment is made by us in error, the Company reserves the right to cancel all bets accepted that contain such error or correct the error by readjusting all bets to the correct terms and conditions that should have been available at the time the bet was placed, provided there was no error.

If we erroneously credit your Player Account with winnings that do not belong to you, whether due to a technical problem, an error in the payout tables, human error or otherwise, the amount remains our property and will be deducted from your Player Account. If you withdraw funds that do not belong to you before we become aware of the error, the incorrectly paid amount (without prejudice to other remedies and actions that may be available at law) will constitute a debt owed by you to us. You must notify us immediately by email if you are incorrectly credited.

The Bookmaker Company, its directors, employees, partners, service providers:

  • Do not guarantee that the software or the Website is suitable for its purposes;
  • do not guarantee that the software and the Website are free from errors;
  • does not guarantee that the Website and/or games will be available without interruption;
  • shall not be liable for any losses, costs, expenses or damages, whether direct, indirect, special, consequential, incidental or otherwise, arising out of your use of the Website or your participation therein.

You hereby agree to fully indemnify and hold harmless the Online Betting Company, its directors, employees, affiliates and service providers for any and all costs, expenses, losses, damages, claims and liabilities however arising in connection with your use of the Website or participation in the Games.

You acknowledge that MCW Casino makes the final decision as to whether or not you have violated the Terms and Conditions of the Company in a manner that results in you being suspended or permanently banned from the Website.

Using a player account

Each player may only create one (1) personal user account. Creation of multiple accounts by a player (“Duplicate Accounts”) may result in termination of the accounts and suspension of all payouts. Any refunds, winnings or bonuses that a player has received or accumulated during the time that the Duplicate Account has been active may be returned to us, and players agree to refund us on demand any such funds that have been withdrawn from the Duplicate Account.

The player must register in person by following the instructions on the screen.

The player must not provide access to his or her account or permit third parties, including but not limited to minors, to use the Website.

The Website may only be used for personal purposes and must not be used for any commercial gain.

Any abusive or obscene language or any commercial or advertising information is not permitted in the “Nickname” field of the player profile. If any violations are detected, the Support staff or other members of the Company may replace the content of the “Nickname” field with something neutral. In case of a repeated violation, the player’s account may be blocked and all funds confiscated.

You must maintain your account and update your information.

Right to withdraw consent. Where we rely on your consent to process personal data, you have the right to withdraw your consent at any time.

We may also retain anonymous derivatives of your data for the purpose of improving our content and marketing communications where automated decision-making is not involved.

MCW Casino reserves the right to request a video verification from the player via Skype. As long as the player fails to go through the verification procedure by calling to Skype at the time agreed upon with a representative of the Risk Department with the possibility to reschedule up to 3 times in case of events beyond the player’s control, the Site Administration reserves the right to close the account. The player has no right to refuse the Verification of Skype call, if it was requested by the Risk Management Department. If a player refuses to pass the Skype Verification, the Site Administration will classify it as a failed verification. In this case, all winnings will be forfeited and the account will remain closed without permission to reopen.

If we mistakenly credit your user account with winnings that do not belong to you, whether due to a technical error, a mistake in the payout tables or human error or otherwise, the amount will remain our property and will be deducted from your Player Account. If you withdraw funds that do not belong to you before we become aware of the error, the incorrectly paid amount (without prejudice to other remedies and actions that may be available at law) will constitute a debt owed by you to us. In the event of an erroneous credit, you must notify us immediately by email.

In the unlikely event of a disagreement between the result that appears on your screen and the game server, the result that appears on the game server will prevail. You acknowledge and agree that our records will be the final authority in determining the terms and circumstances of your participation in the relevant online gaming activity and the results of this participation.

MCW Casino reserves the right to terminate games or events in the exceptional circumstances described below. In the event of miscarriage or malfunction of the game after launching due to a technical error, we shall: 

  • to cancel the game; 
  • to return the played amount; if the account owner has an accumulated credit at the time of miscalculation of the game, to credit the monetary value of the credit to the account owner’s user account or, if the said account no longer exists, to pay it to the account owner in the approved manner; 
  • If necessary, inform the regulator of the circumstances of the incident; 
  • Refrain from continuing to provide games or services if such games or services could be affected by the same failure.

We reserve the right to reject all or part of any transaction requested by you at any time at our sole discretion. No transaction will be accepted by us until you have received confirmation that it has been accepted. If you do not receive confirmation that your transaction has been accepted, please contact Customer Service.

You must reimburse us in full for any claims, liabilities, costs, expenses (including legal fees) and any other fees that may arise as a result of your breach of the Terms.

You may close your account at any time by contacting the team via chat or email.

Anti-fraud policy

The Company has a strict anti-fraud policy and uses various anti-fraud tools and methods. If a player is suspected of fraudulent actions, including, but not limited to:

  • Participating in any type of collusion with other players.
  • You will not engage in any fraudulent, collusive, fixing or other unlawful activity in connection with your participation or that of any third party in any of the Games and you will not use any software or hardware methods or devices to participate in any of the Games. MCW Casino hereby reserves the right to invalidate any bet in the event of such conduct.
  • Fraudulent conduct against other online bookmakers or payment service providers.
  • Chargebacks by credit card or refusal of certain payments.
  • Creation of two or more accounts.
  • Providing false documents.
  • Other types of fraud.
  • or becomes bankrupt in his country of residence.

The Company reserves the right to terminate such a Player Account and suspend all payments to the player. This decision remains at the discretion of the Company, and the player will not be notified or informed of the reasons for such actions. The Company also reserves the right to inform the relevant regulatory authorities of fraudulent activities committed by the player.

You may not use funds that originate from any illegal activity or source, or that are tainted or associated with any illegality or illegally obtained funds. In accordance with our anti-fraud policy, we reserve the right to partially or fully pay any requested withdrawal using the same payment method that was used to make one or more deposits. We also reserve the right to pay any requested withdrawal directly into your bank account.

The online bookmaker has zero tolerance for preferential play. Any player who attempts to take advantage of the online bookmaker’s welcome offers or other promotions agrees that the Company reserves the right to void bonuses and any winnings from such bonuses for reasons of:

  • use of stolen cards;
  • chargebacks;
  • creation of more than one account in order to benefit from promotions;
  • providing incorrect registration information;
  • any other actions that may cause damage to the Company.

The Online Bookmaker reserves the right to close your Player Account and refund the amount in your account balance, subject to deduction of applicable withdrawal fees, at the Company’s absolute discretion and without any obligation to state the reason or give any prior notice.

In order to verify the player’s account, the company management requires documents (identity card, payment systems, utility bills, etc.) in Latin or Cyrillic. If the player can not provide documents in the above alphabets, the company reserves the right to request a video verification, where the player shows his documents.

The company reserves the right to withhold payments if there is suspicion or evidence of manipulation of the company’s system. Criminal charges will be brought against any user or any other person(s) who manipulated or attempted to manipulate the company’s system. 

The Online Bookmaker reserves the right to discontinue and/or change any games or events offered on the Website.

If you become aware of any possible errors or incompleteness in the software, you agree to refrain from using them. In addition, you agree to immediately notify the Company of any errors or incompleteness. If you fail to comply with such obligations, Online Bookmaker shall be entitled to full compensation for all costs associated with the error or incompleteness, including any costs incurred in connection with the relevant error / incompleteness and failed notification.

Please note that if you have requested a withdrawal, but the amount of bets placed since your last deposit is less than three (3) times the amount of that deposit, the Company reserves the right to charge you transaction processing fees for deposits and withdrawals. This decision remains at the discretion of the Company.

The Company complies with European anti-money laundering and counter-terrorist financing laws, regulations and guidelines. Suspicious transactions may be investigated by the Company. The Company reserves the right to send a suspicious transaction report to the competent authorities without notifying or further contacting you. In addition, in the event of any suspicious transactions, the Company may block or close the account and withhold all funds as may be required by law and/or by a competent person.

The company is not a financial institution and therefore should not be treated as such. Your account will have no interest and no conversion or exchange services (including exchanging fiat cryptocurrencies) will be offered at any time.

Complaints

You may contact our customer service department in accordance with the instructions found on the Website to provide us with any complaints regarding our services.

Complaints will be handled by our customer support department and escalated to the MCW Casino organization in the event that the support staff fails to resolve the matter immediately. You should be informed of the status of the complaint at a reasonable level.

If the dispute is not resolved at the management level, you may appeal to any independent body, gambling authority or licensing regulator listed on the Website.

We do our best to resolve complaints within ten (10) calendar days of receipt of the complaint. If a complaint requires more time to resolve, the time period may be extended.

In the event of any dispute, you agree that the server logs and records will serve as the final authority in determining the outcome of any claim. You agree that in the unlikely event of a disagreement between the result that appears on your screen and the game server, the result that has been logged on the game server will prevail, and you acknowledge and agree that our records will be the final authority in determining the terms and circumstances of your participation in the relevant online gaming activity and the results of that participation.
